Policy Purpose

Passed in 1998, The Children's Online Privacy Protection Act ("COPPA") requires all web site operators whose audience includes children under of the age of 13 to post a notice informing parents and legal guardians about how they collect, use, and disclose personal information from children under 13 years of age. Additionally, verifiable consent must be obtained from parents or guardians in order for children under 13 years of age to use the GoTrybe.com web site. The following policy details how GoTrybe complies with COPPA. (Note that when we the word "parent" is used below, GoTrybe includes legal guardians in that definition).

GoTrybe Children's Privacy Policy

The Children's Privacy Policy is designed to educate parents about GoTrybe's privacy practices with respect to children under the age of 13. GoTrybe is dedicated to protecting the privacy of our customers and handling any personal information we obtain from them with care. This policy covers how GoTrybe treats personal information that GoTrybe collects and receives. Personal information is information about you that is personally identifiable like your name, address, email address, or phone number, and which may not otherwise be publicly available. Note that our Children's Privacy Policy does not apply to the practices of companies that GoTrybe does not own or control, or to people that GoTrybe does not employ or manage.

Signup Process

We do not collect personal information from anyone, including children under age 13, unless they sign up for a GoTrybe.com account. During the Signup process, GoTrybe collects only the following information from the child:

  • first name
  • last name
  • gender
  • birth date
  • grade level
  • email address
  • username
  • password
  • secret question and answer

If the child's birth date indicates that they are under the age of 13, the sign-up process also asks for their parent's email address. The parent's email address is used to contact the parent, who has 48 hours to refuse their child's request for a user account. If the child's parent refuses to allow their child's registration, GoTrybe will remove the child's information from its database.

If GoTrybe does not receive a reply back from the parent, GoTrybe assumes parental consent for the child to be a registered GoTrybe user. Once a parent provides consent for their child to register for GoTrybe, the child's user account is activated and can then be used to access the web site.

No other personally identifiable information is collected during the sign-up process

Site Usage

After parental consent is obtained for a GoTrybe user account, GoTrybe only asks for additional information from our members under age 13 which is reasonably necessary to participate in a particular activity. Also, GoTrybe obtains verifiable parental consent via email before contacting children under age 13 about special offers or for marketing purposes.

Additionally, a child's personal information may be collected and used for the child's participation in certain interactive functions of GoTrybe.com, such as using message boards, engaging in instant message chatting, or sending e-mail, etc.

Contests

If a GoTrybe member under the age of 13 seeks to enter a GoTrybe contest, the parent's e-mail address is used to notify the parent of the child's entry request. The parent has 48 hours to refuse their child's request to participate in the contest. If the child's parent refuses to allow their child's contest entry, GoTrybe will not allow the child to be registered for the contest. If GoTrybe does not receive a reply back from the parent, GoTrybe assumes parental consent for the child to participate in the contest. Once a parent provides consent for their child to participate in a contest, the child can enter all future contests without further notification or consent from the parent.

If a child wins a contest, GoTrybe notifies the parent to that effect via an email to the parent's e-mail address that was provided to GoTrybe during the initial registration process. GoTrybe may also request that the parent provide us with their postal address so we can deliver the prize to their residence. GoTrybe may elect to publish the first name, first initial of last name, city, and state of residence of the winner on our Web sites for other GoTrybe members to see.

Third Parties

If any site activities would result in disclosing a child's personal information to third parties, additional means to obtain reliable and verifiable parental consent will be obtained before the child is allowed to participate in these activities. In this instance, GoTrybe may require a parent to provide written consent via postal mail or fax, or to speak with a trained Customer Service Representative via telephone.

Finally, GoTrybe.com may share a child's personal information with third parties when reasonable to:

  • Ensure the availability, integrity and security of our web site or sites
  • Protect against liability
  • Comply with judicial process
  • Provide information to law enforcement
  • Assist with an investigation concerning public safety

Parental Access to Child's Information

Parents can review, edit, and delete information relating to their child's GoTrybe account using features of the GoTrybe.com web site. If at any time a parent notifies us that they no longer want GoTrybe to continue collecting or using their children's personally identifiable information (PII), the child's account and associated information will be deleted as soon as possible.

Policy Updates

Over the course of time, GoTrybe may update this Children's Privacy Policy. GoTrybe will take reasonable and prudent steps to ensure that parents are notified of material changes to our Children's Privacy Policy in conformance with applicable law, including applicable provisions of COPPA. Parents of our members will be notified when significant changes are made concerning how GoTrybe collects and utilizes personal information via an email sent to the parent's email address specified in the GoTrybe user account and placing a prominent notice on our web site. In order to make notification of changes to this policy as efficient as possible, parents should ensure that their contact information, especially their email address, is current and up to date at all times.
